About This Lawsuit

Plaintiff Edward Burks has filed a class action lawsuit against HP Inc. alleging that HP's Limited Warranty for consumer laptop computers violates the Magnuson-Moss Warranty Act, 15 U.S.C. §§ 2301, et seq. HP denies Plaintiff’s claims and contends that HP’s Limited Warranty does not violate the Magnuson-Moss Warranty Act (“MMWA”). HP contends Plaintiff’s theory is based on a deliberate misreading of the HP Limited Warranty. Has the Court Decided Who Is Right?

No. The Court has not ruled on the merits of the claims. The Court certified this lawsuit as a class action, meaning it found the class claims satisfy the legal requirements. HP will file a motion for summary judgment. If the case survives, the lawyers for the Class will have to prove their claims at trial, which has not yet been scheduled.
